Please read these Terms carefully before purchasing a Pass or Pass Credit. By proceeding to payment, you agree to these Terms. These Terms apply in addition to any other terms that apply to your use of the Colchester United Club Site and your Colchester United account. If there is any inconsistency between these Terms and any other terms, these Terms will apply to your purchase and use of the Streaming Service. We may update these Terms from time to time. The terms in force at the time you purchase a Pass or Pass Credit will apply to that purchase. Who we are and how to contact us The Streaming Service is provided by Colchester United FC. Colchester United FC is a company registered in England and Wales under company number 2705301, with registered address at JobServe Community Stadium, United Way, Colchester, CO4 5UP. Our VAT number is GB 974 892 456 In these Terms, "Colchester United", "the Club", "we", "us" and "our" mean Colchester United FC. If you need to contact us about the Streaming Service, including streaming access issues, Pass Credits or refund requests, please contact us at: streaming@colchesterunited.net Definitions In these Terms:Audio Pass means an entitlement for a Pass Holder to listen to a particular Live Event, subject to any Geographical Restrictions.Audio Pass Credit means a credit that can be redeemed for an Audio Pass.Audio Pass Credit Batch means a batch of Audio Pass Credits purchased as part of the same transaction.Club Site means the Colchester United Club Site at https://www.cu-fc.com or any replacement or associated website through which the Streaming Service is made available.Geographical Restriction means a restriction on the availability, purchase, redemption, access or use of a Pass or Pass Credit in or from certain countries or territories.Live Event means an event, generally a football match, made available by Colchester United for live or near-live streaming through the Streaming Service.Pass means an Audio Pass or Video Pass.Pass Credit means an Audio Pass Credit or Video Pass Credit.Pass Credit Batch means an Audio Pass Credit Batch or Video Pass Credit Batch.Pass Holder means the registered Colchester United account holder to whom a Pass or Pass Credit is issued.Streaming Service means the browser-based audio and/or video streaming service made available by Colchester United through the Club Site.Video Pass means an entitlement for a Pass Holder to watch a particular Live Event, subject to any Geographical Restrictions.Video Pass Credit means a credit that can be redeemed for a Video Pass.Video Pass Credit Batch means a batch of Video Pass Credits purchased as part of the same transaction. The Streaming Service The Streaming Service allows eligible users to purchase and access audio and/or video streaming of Live Events made available by Colchester United. The availability of Audio Passes, Video Passes, Audio Pass Credits and Video Pass Credits may vary by Live Event, competition, territory, rights restrictions and any rules or requirements imposed by the relevant football authorities, leagues, broadcasters or rights holders. We may make the Streaming Service available for live and near-live events. Video-on-demand content is not currently covered by these Terms unless expressly stated. If video-on-demand or other streaming products are introduced in the future, additional or updated terms may apply. We do not guarantee that every Colchester United fixture or event will be available through the Streaming Service. We may change, suspend, withdraw or restrict access to the Streaming Service, a Live Event, a Pass or a Pass Credit where required for operational, technical, legal, rights-related, security or regulatory reasons. Colchester United account You must have a Colchester United account to purchase or use a Pass or Pass Credit. You are responsible for keeping your account details, password and login credentials secure. Passes and Pass Credits are personal to the Colchester United account holder to whom they are issued. They must not be transferred, assigned, gifted, sold, shared or otherwise made available to anyone else. You must not share your account access or allow another person to access the Streaming Service using your account. We may suspend, restrict or cancel access to the Streaming Service without refund or Pass Credit if we reasonably believe that your account, Pass or Pass Credit has been shared, misused, used fraudulently, used in breach of these Terms, or used to bypass Geographical Restrictions. Passes Passes must be purchased online through the Club Site. Passes are sold subject to availability, Geographical Restrictions and any rights restrictions that apply to the relevant Live Event. A Pass is valid only for the Live Event for which it is purchased, including any rearranged date if the Live Event is postponed, abandoned or rescheduled. A Pass gives you a personal, limited, non-transferable right to access the relevant Live Event through the Streaming Service, subject to these Terms. A Pass does not give you ownership of, or any intellectual property rights in, the Live Event, broadcast, stream, commentary, footage, audio, video, graphics or other content. Passes are for private and domestic use only. They must not be used for commercial, business, public viewing, broadcast or other non-personal purposes. Audio Passes and Video Passes Audio Pass availability and location restrictions may be configured on a per-event basis. For EFL League, Cup and Trophy fixtures, Audio Passes are expected to be available worldwide, subject to any event-specific restrictions displayed at the time of purchase. For EFL League Two fixtures, Video Passes are available for purchase and use only outside the United Kingdom and Ireland. For EFL Trophy fixtures up to and including the quarter-finals, Video Passes are available for purchase and use only outside the United Kingdom and Ireland. For EFL Trophy semi-finals and finals, Video Passes are not available for purchase or use in any country. For FA Cup fixtures, Video Passes are not available for purchase or use in any country. Pre-season friendlies and U21 matches played at JobServe Community Stadium may be made available on different terms and may not be subject to the same EFL geographical or rights restrictions. The availability of Audio Passes and Video Passes for those events will be shown on the Club Site. The information shown on the Club Site for a particular Live Event will determine the Passes available for that Live Event. Pass Credits Pass Credits may be made available for purchase or issued as a remedy where these Terms say a Pass Credit will be provided. Pass Credits are sold subject to availability, Geographical Restrictions and these Terms. Video Pass Credits are available for purchase only outside the United Kingdom and Ireland. Audio Pass Credit Batches are not currently available for purchase for Colchester United. However, an Audio Pass Credit may be issued where an Audio Pass is refunded as a Pass Credit under these Terms. Pass Credits are redeemable only for the same media type. For example, a Video Pass Credit can be redeemed only for a Video Pass, and an Audio Pass Credit can be redeemed only for an Audio Pass. A Pass Credit must be redeemed for a Pass before you can access a Live Event. Redemption of a Pass Credit may be subject to availability and Geographical Restrictions at the time of redemption. Pass Credits must be purchased and redeemed online. Pass Credits can be redeemed immediately after purchase, subject to any applicable Geographical Restrictions. A Pass Credit Batch remains valid for 12 months from the date the first Pass Credit in that Pass Credit Batch is redeemed. If a Pass Credit is redeemed during its validity period, it may be used against any Live Event available on the Club Site at the time of redemption, subject to availability, Geographical Restrictions and these Terms. For example, if a Pass Credit is redeemed shortly before expiry, it may be redeemed against a Live Event advertised on the Club Site for a later date, provided the Live Event is available for redemption at that time. Unused Pass Credits expire at the end of the applicable validity period. Once expired, they will be removed and will no longer be available for redemption. Pass Credits cannot be transferred, gifted, exchanged for cash or refunded, except where required by law. Changes to the price or availability of Passes after a Pass Credit is purchased will not affect existing Pass Credits, except that all redemptions remain subject to availability and Geographical Restrictions at the time of redemption. Prices, payment and promo codes The price of a Pass or Pass Credit will be shown on the Club Site before you proceed to payment. Payments are processed through Stripe, our payment provider, using Colchester United’s payment account. You must provide accurate payment and billing information. Promo codes may be made available from time to time. Promo codes are subject to any conditions stated at the time they are issued and may be withdrawn or changed at any time. Unless stated otherwise, promo codes: cannot be exchanged for cash; cannot be used retrospectively; may be limited to particular products, events, territories or time periods; and may be limited to one use per account or transaction. Prices may not always be shown inclusive of VAT or tax where the applicable VAT or tax jurisdiction cannot be finally determined until the point of use. Where applicable, tax treatment may depend on your location when purchasing or accessing the Streaming Service. You are responsible for any costs charged by your internet, mobile, device or network provider when accessing the Streaming Service. Geographical and rights restrictions The sale, redemption, access and use of Passes and Pass Credits may be subject to Geographical Restrictions. Geographical Restrictions may apply both: at the point of purchase or redemption; and when you attempt to access or view the Live Event. If you purchase or redeem a Pass outside a restricted territory but later attempt to access the Live Event from a restricted territory, access may be blocked. We may use your IP address, country/location evidence, payment or account information, device information and other technical information to assess eligibility, apply Geographical Restrictions, support rights compliance, determine tax treatment and prevent misuse. You must not use, or attempt to use, any VPN, proxy server, location-masking tool, IP-spoofing tool or other technology or method to bypass or avoid Geographical Restrictions, rights restrictions or eligibility checks. We may suspend, cancel or refuse access to a Pass, Pass Credit or Live Event without refund or Pass Credit if we reasonably believe you are attempting to bypass Geographical Restrictions or rights restrictions. Availability may change at short notice due to league, football authority, broadcaster, rights holder, legal, regulatory, operational or technical requirements. Using your Pass You are responsible for checking the scheduled date and start time of any Live Event. Live Event dates and start times may change at short notice for reasons outside our control. We are not responsible if you miss all or part of a Live Event because you arrive late, use an incompatible device or browser, have insufficient internet connection, experience local device/network issues, are in a restricted territory, use a VPN/proxy/location-masking tool, or otherwise fail to access the Live Event for reasons not caused by us. You must access the Streaming Service only through the official Club Site and only using your own Colchester United account. You must comply with any reasonable instructions or technical requirements shown on the Club Site. Event changes, postponements, abandonment and cancellation We may reschedule, postpone, abandon, cancel or withdraw a Live Event where required for operational, technical, rights-related, sporting, regulatory, safety, security or other reasons. If a Live Event is postponed, abandoned or rescheduled, your Pass will remain valid for the rearranged Live Event. If the Live Event is not rearranged, you will be issued a Pass Credit for the same media type as the original Pass. We will not be liable for any travel, accommodation, internet, mobile, device, data, currency conversion, exchange rate or other costs or losses arising from a Live Event being postponed, abandoned, cancelled, rescheduled or withdrawn. Refunds, Pass Credits and consumer rights Except where required by law or expressly stated in these Terms, Passes and Pass Credits are non-refundable. If a Live Event is not rearranged following cancellation, abandonment or postponement, your remedy will be a Pass Credit for the same media type. If you are unable to access a Live Event because of a material failure of the Streaming Service caused by us or our platform provider, your remedy will be a Pass Credit, unless another remedy is required by law. You will not be entitled to a refund or Pass Credit where your inability to access or view the Live Event is caused by: your device, browser, software or settings; your internet connection, WiFi, mobile network or data connection; insufficient bandwidth; your late arrival or failure to access the Live Event at the scheduled time; your location or a Geographical Restriction; your use or attempted use of a VPN, proxy or location-masking tool; your account details being incorrect or unavailable; your breach of these Terms; or any other reason outside our reasonable control. Nothing in these Terms affects your statutory consumer rights. Because Passes and Pass Credits relate to digital content and/or digital services supplied online, your cancellation rights may be limited once a Pass is used, redeemed, access to a Live Event begins, or the relevant Live Event has taken place. The purchase journey asks you to acknowledge that digital streaming access may be supplied before the end of any cancellation period and that cancellation rights may be lost once a Pass is used, redeemed or the relevant Live Event begins. Nothing in these Terms affects your statutory consumer rights. If you believe you are entitled to a Pass Credit or refund, you must contact us at streaming@colchesterunited.net within a reasonable time, explaining the issue and providing any information we reasonably request. We will consider requests in accordance with these Terms and applicable law. Technical requirements and service availability The Streaming Service is browser-based. To use the Streaming Service, you need a WiFi or broadband internet connection, including DSL/cable or higher, of at least 3000 kbps. Your device must meet the following minimum requirements:Windows PC 2.33GHz or faster x86-compatible processor, or Intel® Atom™ 1.6GHz or faster processor for netbooks; Windows 10, Windows 11 or later Windows releases; latest versions of Microsoft Edge, Mozilla Firefox or Google Chrome; 2GB RAM; 128MB graphics memory. Mac Intel Core™ Duo 2GHz or faster processor; macOS; latest versions of Safari, Mozilla Firefox or Google Chrome; 1GB RAM; 128MB graphics memory. Mobile devices iOS and Android are supported on the latest versions. You are responsible for ensuring that your device, browser, software, settings and internet connection meet the requirements for the Streaming Service. We will use reasonable care and skill to provide the Streaming Service. However, we cannot guarantee that the Streaming Service will be uninterrupted, error-free or available at all times. Streaming may be affected by factors outside our control, including your device, browser, internet connection, local network, ISP, third-party infrastructure, rights restrictions, high demand, maintenance, security issues and events beyond our reasonable control. We may suspend or interrupt the Streaming Service for maintenance, security, technical, operational or rights-related reasons. Support End-user support for the Streaming Service is provided by email only. Support is not available as live, 24-hour or real-time support during Live Events. If you experience an issue with the Streaming Service, you should contact streaming@colchesterunited.net and provide: your name; the email address linked to your Colchester United account; the Live Event; the type of Pass or Pass Credit; a description of the issue; the device/browser used; and any screenshots or error messages, where available. We will aim to respond within a reasonable time. If the issue is caused by a material failure of the Streaming Service, we may issue a Pass Credit in accordance with these Terms. Your responsibilities and prohibited use You must use the Streaming Service only for your own private and domestic purposes. You must not, and must not permit anyone else to: record, copy, reproduce, download, store, forward, transfer, modify, distribute, publish, upload, broadcast, rebroadcast, stream, make available or share any Live Event content; use the Streaming Service or any Live Event content for commercial, business or public viewing purposes; show or make available any Live Event content in a pub, club, workplace, venue or any place where members of the public or a group outside your private household may view it; sell, assign, transfer, delegate, gift or share any Pass, Pass Credit, account access or streaming entitlement; share your account login details or allow another person to use your account; alter, disassemble, decompile, reverse engineer, interfere with, bypass or attempt to bypass any part of the Streaming Service; use any VPN, proxy, IP masking, location-blocking or similar technology to bypass Geographical Restrictions or rights restrictions; access or use the Streaming Service unlawfully, fraudulently or in breach of these Terms; or do anything that may damage, overload, impair, disable or interfere with the Streaming Service. We may suspend, cancel or restrict your access without refund or Pass Credit if we reasonably believe you have breached this section. Intellectual property and content rights All rights in the Streaming Service, Live Event content, audio, video, commentary, graphics, data, software, platform, branding and related materials belong to Colchester United, its licensors, rights holders or service providers. You are granted a personal, limited, revocable, non-exclusive, non-transferable licence to access the relevant Live Event for private and domestic viewing or listening only. No rights are transferred to you except the limited right to access the Live Event in accordance with these Terms. Unauthorised recording, copying, redistribution, rebroadcasting, commercial use or public showing of Live Event content may infringe copyright and other rights and may result in legal action. Suspension or cancellation of access We may suspend, restrict, cancel or refuse access to the Streaming Service, a Pass, Pass Credit or Colchester United account if we reasonably believe that: you have breached these Terms; your account has been shared, misused or compromised; you have attempted to bypass Geographical Restrictions; you have used the Streaming Service for commercial, public or unlawful purposes; you have acted fraudulently or abusively; suspension is necessary for security, technical, legal, rights-related or regulatory reasons; or we are required to do so by a football authority, league, broadcaster, rights holder, regulator or law enforcement body. Where we suspend or cancel access because of your breach of these Terms, you will not be entitled to a refund or Pass Credit. Privacy and personal data We process personal data in connection with Streaming purchases and access as described in the Colchester United Privacy Policy, the Colchester United Club Site Privacy Notice and the Colchester United Club Site Cookie Policy. Personal data used for the Streaming Service may include your Colchester United account details, purchase records, Passes, Pass Credits, entitlements, payment and reconciliation information, refund and chargeback information, IP address, country/location evidence, VAT information and related administration records. We use this information to provide the Streaming Service, manage access and entitlements, process payments and refunds, apply rights and Geographical Restrictions, comply with tax/VAT/accounting obligations, prevent misuse and support the Streaming Service. Our liability to you We are responsible for losses you suffer that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill. We are not responsible for losses that are not foreseeable. We are not responsible for: any business losses, including loss of profit, loss of business, business interruption or loss of business opportunity; losses caused by your device, browser, software, settings, internet connection, mobile network, ISP or local network; losses caused by your failure to meet the technical requirements; losses caused by your breach of these Terms; losses caused by Geographical Restrictions, rights restrictions or regulatory restrictions; losses caused by events outside our reasonable control; or losses caused by third-party services, except where we are legally responsible for them. Nothing in these Terms excludes or limits our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; breach of your statutory consumer rights; any matter for which we cannot exclude or limit liability by law. Changes to the Streaming Service and these Terms We may update the Streaming Service from time to time, including to improve functionality, address security issues, reflect rights restrictions, comply with law or make operational changes. We may update these Terms from time to time. The latest version will be made available on the Club Site. Changes to these Terms will not affect any Pass or Pass Credit you have already purchased unless: the change is required by law; the change is required for security, rights or regulatory reasons; the change benefits you; or the change does not materially reduce your rights. Complaints If you have a complaint about the Streaming Service, please contact us at streaming@colchesterunited.net. We will consider complaints in accordance with these Terms and applicable law. If your complaint relates to personal data, please use the data protection contact details in the Colchester United Privacy Policy. Governing law and jurisdiction These Terms are governed by the laws of England and Wales. If you are a consumer living outside England and Wales, you may also have the benefit of any mandatory consumer protection rights that apply in your country of residence. You can bring legal proceedings in the courts of England and Wales. If you live in Scotland, you can bring legal proceedings in either the Scottish courts or the courts of England and Wales.
